OK so here is the small print! I know nobody likes reading through this stuff but it is important for your safety and enjoyment of our Segway Tours/Activities so please take a few minutes to go through it. If after reading it you have any questions please get in touch before you book and we’ll give you whatever additional information or clarification you require
For the purpose of this document, the following definitions apply:
1.1. “Us” / “We” / “Our” refers to Beelancer LTD.
1.2. “Segway” / “Ninebot Segway miniPRO” refer to the Ninebot Segway miniPRO utilised by Beelancer LTD.
1.3. “Segway Tour/Activity” / “Segway Tours/Activities” refers to any of the activities offered by Beelancer LTD involving the use of Ninebot Segway miniPRO.
1.4. “Instructor” / “Guide” refers to employees of Beelancer LTD who deliver any of the Segway Tours or Activities offered by Beelancer LTD including the mandatory training in the operation of the Ninebot Segway miniPRO which is an integral part of all Tours/Activities.
1.5. “You” / “Your” refers to the person making a booking for a Segway Tour/Activity, any person signing these terms and conditions and any person purchasing goods, services or hiring Ninebot Segway miniPRO from Beelaner LTD.
1.6. “Participant” refers to every person who participates in a Segway Tour/Activity offered by Beelancer LTD.
1.7 “Beelancer LTD” Refers to online hire service provided by Beelancer LTD of Ninebot Segway miniPRO on www.hirebot.ie
2.1. When You make a booking for a Segway Tour/Activity with Us, You must read, understand and agree to all of the terms and conditions in this document.
2.2. If You are booking on behalf of others, You are responsible for ensuring that they agree to all of the terms and conditions in this document.
2.3. All Participants must sign a statement of risk indicating that they understand and accept the inherent risks associated with using a Ninebot Segway miniPRO and that they have read and understood these terms and conditions before they will be permitted to participate in any of Our Segway Tours/Activities.
2.4. If a Participant does not agree to these terms and conditions, their booking will be terminated as per the standard Termination/Cancellation Policy.
2.5. All bookings must be accompanied by a valid form of ID (e.g. Garda ID, Drivers License, Passport) and a valid credit card. If you are booking for a group only one form of ID and credit card is required however the ID and credit card must belong to the same individual who agrees to take responsibility for any damage/loss caused by any member of the group under which the booking is made.
3.0 GENERAL TERMS
3.1. Tour/activity bookings are made for a specific date and time. It is Your responsibility to arrive on time on the correct date.
3.2. All tours begin with a mandatory training session. Even if you have been on a Segway before or happen to be the world Segway champion the training session is mandatory for insurance and health and safety purposes.
3.3. If You arrive too late You may miss the mandatory training/orientation session at the start of Your tour/activity. In this case we will do our best to reschedule Your tour on the day however if this is not possible then all payments may be forfeited. If You do not arrive at all for your booked Segway Tour/Activity your booking will be terminated and no refund will be available. Please see Cancellation Policy.
3.4. Segway Tours/Activities will operate in almost all kinds of weather; however, We reserve the right to cancel a booking if We consider the weather conditions adverse enough to affect the safety of Our Participants. If in any doubt, contact Us on the day of Your scheduled booking. Please also see Cancellation Policy.
3.5. Any photographs or video material captured by Us during any of Our Segway Tours/Activities may be used by Us for promotional purposes, including, but not limited to, publication on Our website and/or Facebook page. If you have an objection to the use of photo or video material which includes you please let us know and we will not use it for any promotional purposes.
3.6. The duration quoted for any Segway Tour/Activity is approximate and may vary depending on group size, ability and pace.
3.7. The distance quoted for any Segway Tour/Activity is approximate and is limited by the quoted duration.
3.8. We reserve the right to amend these terms and conditions from time to time.
3.9. Beelancer LTD provides access to Ninebot Segway miniPRO for Hire by customers in the Deise Greenway.
3.10. All Ninebot Segway miniPRO must be used in a reasonably and responsible way.
3.11. The period of hire is the agreed time in which the Ninebot Segway miniPRO will be used, failure to abide by this will result in the forfeiture of deposit until extra costs are recouped.
3.12. The customer is responsible for the Ninebot Segway miniPRO hired and must make every effort to avoid damage to the Ninebot Segway miniPRO or its destruction or disappearance.
3.13. The customer undertakes to inform the Beelancer LTD as swiftly as possible of the loss, theft, any accident or any other problem in relation to the use of a Ninebot Segway miniPRO. In any event the Ninebot Segway miniPRO shall remain under the responsibility of the customer in accordance with the terms of paragraph [11 ] and [14 ].
3.14. The Ninebot Segway miniPRO remains at all times the property of the Beelancer LTD. The customer is expressly forbidden to allow any third party to use the Ninebot Segway miniPRO in any way whatsoever, whether for free or against consideration.
3.15. The service provided by the Beelancer LTD is also accessible to children up to the age of 12 once the Ninebot Segway miniPRO are hired by their legal guardian under the liability of this clause and in accordance with paragraph [ ] below.
3.16. The customer is authorised to use the Ninebot Segway miniPRO in accordance with the terms hereof, provided that such use is reasonable which excludes the following:
(a) Any use contrary to the provisions of the Rules of the Road and current traffic regulations;
(b) Any use on land or under conditions that are likely to damage the Ninebot Segway miniPRO;
(c) The transportation of any passenger under any circumstances;
(d) Any use of the Ninebot Segway miniPRO causing danger to the customer or to third parties;
(e) Any dismantling or attempt to dismantle all or part of the Ninebot Segway miniPRO, and more
(f) Generally, any abnormal use of a Ninebot Segway miniPRO.
3.17. Any goods carried by customers, either on their person or on the Ninebot Segway miniPRO is at the risk of the customer.
3.18. Damage to or the soiling of a customer’s clothing while using a Ninebot Segway miniPRO is at the risk of the customer
4.0 PARTICIPANT REQUIREMENTS
Participants failing to meet any of the following requirements will not be able to participate in any part of Our Segway Experiences and will be subject to the standard Termination/Cancellation Policy – any queries should be raised before bookings are made:
4.1. Participants must be at least 12 years of age.
4.2. A parent/legal guardian or responsible adult (who has obtained consent from the parent/legal guardian) must sign a consent form for participants aged 12 to 17 years old.
4.3. Participants must weigh at least 45kg (approximately 7 stone / 100 lbs).
4.4. Participants must be no heavier than 110kg (approximately 18 stone / 245 lbs).
4.5. Participants must wear a helmet. Helmets will be provided but Participants may bring along their own providing it meets recognised safety standards.
4.6. Participants must wear suitable footwear (e.g. trainers or comfortable shoes) and clothing.
4.7. Participants must be able to stand for the duration of their Segway Tour/Activity without stopping (for toilet breaks, rests etc.).
4.8. Participants must be able to step on-to and off the base of their Ninebot Segway miniPRO unassisted (following training). The step is approximately 8 inches / 20 CM tall.
4.9. Participants must be able to lean from side-to-side and forwards and backwards, whilst standing upright on their Ninebot Segway miniPRO.
4.10. Participants must not be under the influence of drugs or alcohol.
4.11. Participants must have adequate vision in order to safely operate a Ninebot Segway miniPRO, which can move at speeds up to 11MPH, and must wear any prescribed glasses where appropriate.
4.12. Participants must have adequate hearing (or assisted hearing) or be otherwise able to understand and respond to instructions from Us.
4.13. Participants must speak/understand English in order to respond to instructions from Us. Non-English speaking Riders will need to be accompanied by a translator.
4.14. Participants must inform their Instructor of any impairments which may affect their safety before participating in Our Segway Tour/Activity.
4.15. Pregnant women, people with back injuries or other serious health problems should not participate in any of Our Segway Tours/Activities. We strongly recommend that people with underlying medical conditions such as osteoporosis, osteoarthritis, arthritis, musculoskeletal disorders (e.g. joint or back problems) or any other disorder or condition that could be exacerbated by an accidental fall from the Segway should NOT participate in Beelancer LTD Tours or Activities.
5.0 ACCEPTABLE BEHAVIOUR
Inappropriate behaviour will result in the offending Participant’s Segway Tour/Activity being terminated, as per the standard Termination/Cancellation Policy:
5.1. Verbal or physical abuse against Our employees, customers, equipment, operating environment and any third parties who may be present will not be tolerated under any circumstances. This includes but is not limited to aggressive, dangerous and intimidating behaviour or language.
5.2. Participants are not permitted to smoke at any time whilst operating a Ninebot Segway miniPRO.
5.3. Participants are not permitted to use mobile phones, cameras or recording equipment whilst operating a Ninebot Segway miniPRO, unless the Ninebot Segway miniPRO is stationary.
5.4. Participants are not permitted to stop, fall behind, or hinder the group’s progress in order to make use of their mobile phones, cameras or recording equipment. The group will stop at several safe locations and any other requests should be agreed with the Guide.
5.5. We operate to Leave No Trace Principles (see www.leavenotrace.ie for further details) and ask that you respect our beautiful environment. Participants must not drop litter or interfere with wildlife at any time during their Segway Tour/Activity.
5.6. Participants must follow the instructions of their Guide – at all times – relating to all aspects of their Segway Tour/Activity.
5.7 The trails at Waterford Greenway are used by walkers and cyclists. Other users of trails will always be afforded right of way. When passing other trail users all Segway riders will pass in single file at low speed.
6.0 TERMINATION/CANCELLATION POLICY
We’re sure you’ll love Beelancer LTD tours and activities and really hope that you don’t have to cancel. However sometimes unforeseen events get in the way and so with this in mind we try to operate a simple and fair cancellation policy.
Should you need to amend or cancel a confirmed tour booking the following policy applies
6.1. Any amendments or cancellations to your booking must be made in writing via email to Beelancer LTD (the email address is email@example.com). Only when you receive an acknowledgement from us should you deem the amendment or cancellation to be made. If you do not receive an acknowledgement please contact us again.
This is really important so we’ll say it again a little louder!
YOU MUST RECEIVE A WRITTEN ACKNOWLEDGEMENT FROM US STATING THAT YOUR AMENDMENT OR CANCELLATION HAS BEEN ENTERED ONTO OUR BOOKING SYSTEM.
6.2. If You cancel your booking more than 7 days prior to your allotted time you have the option to reschedule your tour to a new date (subject to availability) or request a full refund of the total amount paid.
6.3. If You cancel Your booking between 7 days and 2 days prior to the scheduled booking commencing you will have the option to reschedule your tour date only (subject to availability). However, if we can resell all of your original tour places then we will happily provide a full refund.
6.4. If you cancel your booking with less than 48 hours notice (from your allotted time) there will be no option to reschedule or refund unless all tour places are re-sold.
6.5. In the case of a no show no option for rescheduling or refund will be available
6.6. Reducing booking size without the above notice – You will be liable for the full payment of original booking.
6.7. Should We need to cancel due to poor weather or other unforeseen circumstances We will refund the full cost of the tour you had booked with us. Please note that we will refund the tour cost only and that we will not accept responsibility for any travel arrangements or costs that may be incurred on your part. We always advise that you contact us before travelling to make sure that all tours are proceeding as advertised.
6.8. We reserve the right to prohibit any Participant, prior to commencement, during training or during operation, from participating or continuing to participate in any of Our Segway Tours/Activities, if they fail to meet the General Terms, Participant Requirements or do not maintain Acceptable Behaviour, as specified in these terms and conditions. In such cases, a Participant’s Segway Tour/Activity will be terminated and no refunds or alternative dates will be offered.
6.9. Following training, if a Participant cannot control a Ninebot Segway miniPRO to the standard required by their Instructor, they will be unable to participate further. Any bookings made with a direct payment will be refunded upon request.
7.0 LIABILITY WAIVER/DISCLAIMER
7.1. There is a risk of death or injury when using a Ninebot Segway miniPRO. We will provide sufficient training so as to minimise all reasonable risks, however we cannot fully eliminate the risk involved in using a Ninebot Segway miniPRO, therefore, You acknowledge that Our Segway Tours/Activities are undertaken at Your own risk.
7.2. You agree that We are not responsible for any personal injury, death, loss or damage which may occur, unless it occurs as a direct result of Our negligence.
7.3. If You cause any damage, loss, injury or death, as a result of inappropriate actions or wilful neglect, which has not resulted directly from Our negligence, You accept liability for these actions and agree to be held accountable for them.
7.4. You will be required to read and sign our standard Disclaimer before participating in any of Our Segway Tours/Activities.
7.5. You should be aware that where you link to another website from the Beelancer LTD website, that we have no control over that other website. We have no responsibility for the privacy practices of other websites.
8.0 GIFT VOUCHER SALES
8.1. Gift Vouchers can be used as part payment or full payment (value permitting) for any of the Segway Tours/Activities run by Us.
8.2. The availability of Segway Tours/Activities is limited and subject to change. Current availability can always be checked on our website. Book early to ensure you get the best choice of dates and times for use with Your voucher.
8.3. Gift Voucher purchases are non-refundable under any circumstances.
8.4. Any unused credit following voucher redemption will be converted to a new gift voucher in the amount of the unused credit.
8.5. Vouchers are only valid for the period stated at the time of purchase, which commences immediately following purchase. The expiry date is clearly stated on all vouchers.
8.6. Vouchers cannot be used beyond their expiry date.
8.7. Vouchers are immediately deactivated when redeemed. You are responsible to ensure nobody else uses your unique voucher code.
9.1. Refunds are only permissible as per these terms and conditions.
9.2. Refunds for payments received less than 60 days ago will be made by the original payment method where possible.
9.3. If a refund is due more than 60 days after the original payment was received, refunds will not be made via PayPal. Refunds in these circumstances will be made via a cheque payment.
10.0 CREDIT CARD CHARGEBACK
10.1. In the event that a credit card charge is disputed and it is proven that the charge was legitimately applied the cardholder will be held liable for all costs incurred in proving that the charge was legitimate plus a €100 administration fee.
11.0 PAYMENTS AND SECURITY DEPOSIT
11.1. Beelancer LTD accepts online credit card payments and cash payment
11.2. At the moment of agreement with terms of service customer agrees on a security deposit of €500
11.3. Credit card information is kept on profile in order to retrieve to Security Deposit for the case of damaged or stolen Ninebot Segway miniPRO
11.4. Beelancer LTD may retain Legal Government I.D. as a Security Deposit
11.4.1. Legal Government I.D. Does not exclude or replace monitory Security Deposit and may be used in order to proceed with Legal action to redeem the Security Deposit
11.5. Beelancer LTD may charge the Payment Method used to make a payment in order to collect any Security Deposit associated with the hire of Ninebot Segway miniPRO, as well as any amount of the Damage Claim/outstanding payments exceeding any Security Deposit.
11.6. Legal I.D. is returned in the case of Ninebot Segway miniPRO is returned within the 24 hours of renting the Ninebot Segway miniPRO
11.7. If the Ninebot Segway miniPRO is not returned within the hired timeframe, Beelancer LTD is in full power of charging the additional €10/hour and cannot exceed the Security Deposit of €500
12.1 Beelancer LTD and its subsidiaries fully respect your right to privacy in relation to your interactions with this website.
13.0 COLLECTION AND USE OF INFORMATION.
13.1. We will not collect any personal information about you on this website without your consent. We will let you know what we intend doing with your information before collecting it, so that you can decide whether or not to furnish that information to us.
Any information which is provided by you will be treated with the highest standards of security and confidentiality.
13.2. If at any time after giving us personal information you decide that you no longer wish us to hold or use this information, or in the case that the information becomes out of date, you are free to notify us, and we will remove or rectify the information within a reasonable time and in accordance with legislative requirements.
13.3. You acknowledge and agree that in certain circumstances we may be obliged to disclose personal information relating to you to third parties, for example, in order to conform to any requirements of law or to comply with any legal process, as well as to protect and defend the rights of property of Beelancer LTD, our licensors and/or our other customers.
13.4. Telephone calls may be monitored or recorded to ensure that we carry out your instructions correctly and to help improve the quality of our service and in the interests of security.
14.2. Statistical and analytical information collected through the standard operation of our internet servers and logs provides us with general and not individually specific information. We will make no attempt to identify individual users, or to associate any technical information collected with any individual user.
15.1. Beelancer LTD reserves the right in its sole discretion to amend this privacy statement at any time, and you should regularly check this privacy statement for any amendments.
